GENERAL TERMS AND CONDITIONS AND PARKING RULES FOR THE BTC CUSTOMS TERMINAL PARKING AREA

The general terms and conditions and parking rules for the use of the BTC CUSTOMS TERMINAL parking area are determined by the owner, BTC, d. d., Ameriška ulica 2, 1000 Ljubljana.

The general terms and conditions and parking rules apply to all users of parking spaces in the BTC CUSTOMS TERMINAL parking area, Letališka cesta 16, and BTC, d. d., reserves the right to change them. The general terms and conditions and parking rules (and any amendments thereto) shall be deemed valid and binding for users of parking spaces from the date of their publication on the www.btc.si website and upon any use, entry and exit points and entrances to parking spaces in the BTC CUSTOMS TERMINAL area.

 

1.    General Provisions

The BTC CUSTOMS TERMINAL parking area includes parking spaces, access and exit roads, and all the equipment in the area behind the parking area barrier at BTC CUSTOMS TERMINAL. BTC, d. d., allows users to use parking spaces marked with floor markings. Access to the parking area is only possible via the barrier at the entrance through the ANPR system with automatic number plate recognition. Exit from the area is only possible upon payment of the parking fee in the event of exceeding the free parking time at the exit terminal or exit barrier.

Users are all drivers who have driven their vehicles into the BTC CUSTOMS TERMINAL parking area, together with their passengers or companions, and any other person who is in the parking area of the BTC CUSTOMS TERMINAL, regardless of the reason or justification.

Upon entering with a vehicle through a barrier with an ANPR system, a parking space rental agreement is concluded between BTC, d. d., and the vehicle user, which the daily user chooses themselves and can also change during the term of the parking space rental agreement, whereby the user can only choose a free parking space. The subject of the rental agreement is no other area than the marked parking space. The parking space rental agreement also includes the generally applicable terms and conditions and the user’s commitment to pay for the parking space according to the currently applicable price list of BTC, d. d. Upon entering the parking area, the individual is deemed to have familiarised themselves with the processing of personal data as defined below. If the user does not agree with the recognition of the vehicle license plate number, they must turn the vehicle around in front of the barrier at the entrance to the parking area and leave the parking area. Notwithstanding the above, these general terms and conditions shall nevertheless apply until the user exits the BTC CUSTOMS TERMINAL parking area.

If the user abandons the vehicle in the parking spaces of BTC CUSTOMS TERMINAL (the vehicle has no license plate number, the tires are flat, the vehicle is unlocked, damaged or inoperable, or no one is taking care of it, it is parked incorrectly, etc.), they thereby allow BTC, d. d., to remove the vehicle from the parking area at the expense of the user or owner of the vehicle. BTC, d. d., is not liable for any damage that may occur during the removal of the vehicle from the BTC CUSTOMS TERMINAL parking area and is entitled to claim a flat-rate removal fee of EUR 250.00 + VAT from the user or owner of the vehicle. A vehicle is also considered abandoned if it is parked continuously for more than 30 days in the parking spaces in the BTC CUSTOMS TERMINAL parking area without prior written agreement with BTC, d. d.

Upon entering the BTC CUSTOMS TERMINAL parking area, i.e. upon driving through the barrier at the entrance to the BTC CUSTOMS TERMINAL parking area, the user is obliged to observe road traffic signs, floor markings, road traffic regulations, traffic signals, price list, instructions of the parking space owner and these general terms and conditions.

The user undertakes to park the vehicle within the marked parking space with all four wheels within a single parking space lines and not to obstruct other users when parking. Parking spaces reserved for disabled persons and parking spaces specially marked for certain other categories of users or vehicles may only be used by them. Pedestrians are required to move only in areas marked for pedestrian crossings. Users are required to follow all instructions and fire regulations applicable in the BTC CUSTOMS TERMINAL area. The use of open flames or fire-hazardous devices is not permitted in the area, nor is it permitted to leave objects, change oil, repair, maintain, or wash vehicles.

The transfer of goods between vehicles is prohibited.

 

2.    Parking Fee Payment

Users are required to pay parking fees in accordance with the current price list of BTC, d. d., for parking spaces in the BTC CUSTOMS TERMINAL area. The current price list is published on the www.btc.si website, at the entrance to the BTC CUSTOMS TERMINAL area and at the automatic cash register.

The parking time is recorded automatically. When a vehicle passes through the barrier into the BTC CUSTOMS TERMINAL parking area, the vehicle’s number plate, date and time of passing through the barrier are recorded in the information system, and the driver takes a parking ticket. Only vehicles with paid parking fees can exit the parking area. Exiting the parking area is only permitted after prior payment of the parking fee or within the time window that allows free parking.

If the user leaves the outdoor parking area without paying the parking fee, this does not mean that the rental agreement is terminated; rather, the rental agreement is only terminated upon settlement and payment of the parking fee. In the event of departure without payment of the parking fee, BTC, d. d., may charge the user a contractual penalty of EUR 250.00 in addition to the parking fee. BTC, d. d., may also charge the user a contractual penalty of EUR 250.00 in the event of other violations of these general terms and conditions. Abuse of parking and any other violation of these general terms and conditions by the user shall be considered a violation. Abuse of parking means any conduct contrary to these general terms and conditions, in particular abuse of the system for exiting the parking area with one or more vehicles without payment. In the event of a violation of these general terms and conditions, BTC, d. d., has the right to charge the violator a contractual penalty and to prevent them from entering the BTC CUSTOMS TERMINAL parking area in the future. BTC, d. d., has the right to hold violators criminally and civilly liable.

Persons who are not users of the parking area or do not accompany the user of the BTC CUSTOMS TERMINAL parking area are prohibited from entering and staying in the parking area. This also applies to all areas of the parking area entrances and exits, as well as areas where cash registers, payment registers and other devices are located.

Subscribers who have an agreement under which they pay monthly for parking spaces for access to the parking area receive an access control device with which they can access and exit the parking area. Only one access device can be obtained for each parking space purchased.

Subscribers who pay by collective invoice do not check out at the automatic cash register but at the cash register at the gate. This exit is only possible on weekdays between 7:00 and 20:00.

 

3.  Damage Liability

Users of the parking area and their passengers or companions in the BTC CUSTOMS TERMINAL parking area park at their own risk. BTC, d. d., assumes no responsibility for the vehicles during parking and is not liable for any damage to the vehicles or inside the vehicles that occurs during parking or driving within the parking area. BTC, d. d., is not liable for any damage caused by third parties, nor is it liable for the loss or theft of vehicles or personal items located in the parking area. BTC, d. d., is not liable for death or bodily injury and related material damage suffered by the injured party – the user of the parking area. Notwithstanding the above, users or their passengers are obliged to immediately notify BTC, d. d., or the security staff in the area of the damage and to allow inspection and securing of evidence before the vehicle is moved or otherwise jeopardizes the reliable recording of the circumstances of the alleged damage event.

Users are aware that this is an outdoor parking area exposed to weather conditions, where moisture and stains regularly appear on the ground due to liquids leaking from vehicles, and agree that BTC, d. d., is not obliged to ensure impeccable walking and driving surfaces at all times. In the event of precipitation, users must expect the driving and walking surfaces to be wet and slippery and move around the parking area accordingly, in which case no special notices regarding wetness, frost or other surface conditions are required. Liability for damage caused by the staff of BTC, d. d., is excluded when the damage is caused in an emergency.

Parking area users are liable for any direct or indirect damage to people (users) or property in the parking area caused by their actions.

 

4.  General Information about Video Surveillance and ANPR

The BTC CUSTOMS TERMINAL parking area is protected by video surveillance for the purpose of monitoring entry to and exit from the parking area, protecting the employees and the parking area property, preventing damage and maintaining order. The video surveillance system covers all parking area users. Parking area users are informed about the video surveillance via notices posted at the entrance to the area and about automatic number plate recognition (ANPR) via notices placed in front of the barrier for entry and exit to the BTC CUSTOMS TERMINAL parking area, at all entrances and exits to the pedestrian area, as well as in the parking area itself. The notices contain information that video surveillance and ANPR are being carried out by BTC, d. d., and a link to a website where parking area users can obtain information about where and for how long recordings from the video surveillance system are stored. Recordings are deleted in accordance with the capacity of the hardware, but no later than 180 days after they have been recorded, unless recordings of individual events are stored in compliance with the provisions of the regulations for the protection of the legal interests of BTC, d. d.

The video surveillance system is operated by BTC, d. d., Ameriška ulica 2, 1000 Ljubljana, phone number: (01) 5851572. Users expressly agree that video recordings may be used as evidence against them in case of violations.

The automatic number plate recognition system is used for entering and exiting the parking area to ensure order, safety and proper parking fee billing. At the entrance and exit, there are notices about ANPR in front of the number plate recognition system. Any individual who does not agree with automatic number plate recognition may turn their vehicle around before entering the parking area and not enter the area under surveillance. License plate data is stored for the period from entering the parking area via the ANPR system until exiting the parking area. The license plate information is deleted from the system upon leaving the parking area, immediately after the system opens the barrier for the individual to exit the parking area. The ANPR system is operated by BTC, d. d., and the authorised company TENZOR, d. o. o.

 

5.  Personal Data Processing

In compliance with the provisions of the General Data Protection Regulation (EU Regulation No. 2016/679; hereinafter: General Regulation) and the Personal Data Protection Act (ZVOP-2), the controller is BTC, d. d., Ameriška ul. 2, 1000 Ljubljana.

BTC, d. d., manages a database of personal data generated as a result of the use of the video surveillance system. As a result of the use of the automatic number plate recognition system, BTC, d. d., manages a database of daily users of the BTC CUSTOMS TERMINAL parking spaces, in which data on the registration number, date, and time of entry into and exit from the parking area is processed. All user data is collected and processed solely for the purpose of implementing the contract for the rental of a parking space within the BTC CUSTOMS TERMINAL parking area (the legal basis for processing is Item (b) of Paragraph 1 of Article 6 of the General Regulation). The data is deleted from the database immediately after the individual leaves the parking area with their vehicle, after the barrier closes. In an event of non-payment of parking fees, the data is stored for a further 180 days after leaving the parking area (for the purposes of enforcing or defending against various legal claims that may arise from the contractual relationship between the user and BTC, d. d.). The data is forwarded to the operators or subcontractors of the automatic number plate recognition system:

BTC, d. d., also maintains a database of damage events reported by users as events for which the staff of BTC, d. d., is responsible. This database contains information about the person reporting the damage (name, address, contact details), information about the damage event (a report or a brief description of the alleged damage event), information about the alleged perpetrator of the damage (personal name, job title), and other data relevant to the assessment of the liability for damages by BTC, d. d. The data in this database is processed solely for the purposes of assessing liability for damages or for asserting claims or defending against claims by alleged injured parties (the legal basis for processing is Item (f) of Paragraph 1 of Article 6 of the General Regulation, whereby the legitimate interest is the processing of claims by alleged injured parties by the controller). Such data is stored for a maximum of three years or until the conclusion of any legal proceedings. BTC, d. d., does not transfer personal data to third countries. All contractual partners – personal data processors who process personal data in addition to the controller’s employees – are based in the European Union and have signed a personal data processing agreement. BTC, d. d., does not disclose users’ personal data to third parties, unless it is required to do so in order to comply with legal obligations or if the user agrees to such disclosure.

During the processing of personal data, individuals have the right to access, rectify, restrict the processing of, or delete all or individual data in compliance with applicable regulations, by submitting a written request to the contact details specified below. The individual has the right to object to the processing of personal data, the right to data transfer, and the right to lodge a complaint with the Information Commissioner.

Requests to exercise rights relating to the protection of personal data may be addressed to the controller by post at BTC, d. d., Ameriška ul. 2, 1000 Ljubljana, or by email at vop@btc.si.

 

6.  Obligations of Users and Persons Located in the Parking Area

Road traffic regulations and other instructions issued by BTC, d. d., apply in the BTC CUSTOMS TERMINAL parking area. In the event of non-compliance with road traffic regulations, BTC, d. d., is entitled to take action in compliance with the regulations and these general terms and conditions.

Parking area users and other persons located in the parking area are required to:

  • observe road traffic regulations – traffic signals (road markings, traffic signs, light and sound signals);
  • always pay for parking if the free parking period has expired;
  • turn off the vehicle immediately after parking it in the designated space and ensure that the vehicle will not move while parked;
  • keep the daytime running lights on when driving in the parking area;
  • leave the parking area immediately after paying the parking fee;
  • ensure that no oil or other harmful liquids leak from the vehicle;
  • remove snow from the vehicle before entering the parking area;
  • as pedestrians, move only in areas marked for pedestrian traffic and move carefully and in accordance with weather conditions;
  • in the event of irregularities, damage, or other violations of these general terms and conditions and parking regulations, immediately notify BTC, d. d., employees or security staff.

 

7. Prohibited Behaviour of Parking Area Users:

Users are not allowed to:

  • drive faster than 10 km/h;
  • park outside marked parking spaces;
  • park vehicles in such a way that it prevents other users from entering/exiting their vehicles normally and obstructs traffic on the roadways;
  • enter the parking area with a vehicle with a trailer;
  • cause damage to equipment, devices, or vehicles in the parking area;
  • leave personal items outside the vehicle or in a visible place inside the vehicle, repair or service vehicles in the parking area, etc.;
  • deposit or store objects, materials, substances and municipal waste;
  • smoke, sit, sleep, consume alcohol, beg or panhandle;
  • place advertising signs, distribute flyers or other marketing materials;
  • stop vehicles on driving, entry, exit and intermediate lanes, or overtake other vehicles;
  • turn vehicles around or drive in reverse;
  • remove or move parking area equipment or devices.

 

8.   Surveillance

The operator of the video surveillance system is BTC, d. d., Ameriška ul. 2, 1000 Ljubljana, www.btc-city.com/sl/videonadzor (in Slovene).

The authorised person for data protection at the company is IEPRI, d. o. o., Dunajska 106, Ljubljana. The legal basis for the processing of personal data is the legitimate interest of the controller (Item f of Paragraph 1 of Article 6 of the General Data Protection Regulation). The purpose of processing personal data (video recordings) is to protect people and property and to prevent damage and criminal acts within the area by means of video surveillance in common areas and outdoor areas in the scope of the business premises (video surveillance is not carried out in elevators and restrooms). Video recordings are used to determine the relevant circumstances in relation to claims for compensation for damage incurred or to prepare proposals for criminal or misdemeanour prosecution in the event of any damage or unlawful event.

Video recordings may be forwarded to the controller, security staff, authorised law firm and insurance company, as well as to state authorities, such as the police, court, prosecutor’s office, inspection services, etc. in cases specified by law, or in cases of legitimate interest in relation to the initiation of criminal and other proceedings to protect the legal interests of the controller.

Events can also be monitored live via the video surveillance system. Recordings are not transferred to entities in third countries. Recordings from the video surveillance system are stored in accordance with the system’s capacity, but for a maximum of 180 days. There is no automated decision-making related to the implementation of video surveillance.

You have the right to request access to your personal data, rectification or deletion of personal data and restriction of processing from the controller. You also have the right to object to processing, data transfer and to lodge a complaint with the supervisory authority (Information Commissioner). You can exercise your rights against the controller at the above email address.

Compliance with the general terms and conditions and parking rules is monitored by the staff of BTC, d. d., and authorised security staff. In the event of a violation of the provisions of these general terms and conditions, authorised BTC, d. d., employees or the security staff may take the following measures against the violator: issue a warning, prohibit entry to the area under surveillance, which also includes the parking area, remove the person from the area, and take other necessary measures to ensure order in accordance with legal powers.
